The Role of Buyer’s Agent
In 1993 the State of Georgia introduced the “policy of agency”. Typically, the listing agent represents the seller and the buyer’s agent represents the buyer. Agents can elect to represent either seller or buyer or both. Agents have a choice! Buyers have a choice! The seller is paying the commission and it is paid to the brokerage of the listing agent. That brokerage in turn pays half of the received commission to the brokerage of the Buyer’s agent. The individual agent is then paid on whatever level has been agreed upon in their office contract.
Should the listing be listed by the Buyer’s agent’s office, the agents can elect to represent either seller or buyer. Dual representation is when the agent represents both buyer and seller. In such a case, the agent pledges fairness and honesty. The agent can designate another agent in the office should the buyers want their own representation.
Buyer Representation - Benefit to the Buyer:
1. Total commitment to the Buyer.
2. Maximum effort on their behalf.
3. Exposure to the entire market.
4. Confidentiality.
5. Disclosure and loyalty.
6. Susan and Jonathan’s track record of successful negotiations.
7. Privacy for the Buyer and assistance with financing.
8. Strongest possible protection of Buyer’s interests.
9. Buyers may save money since Susan and Jonathan will be working to protect their interest.
Benefit to Susan and Jonathan as their agent:
1. Buyer loyalty.
2. More qualified buyer.
3. Buyer educated to the market place.
4. Peace of mind, less conflict of interest.
5. Ability to offer more services.
Will the Buyer need to sign an agreement?
Now it is State Law for the agent to have an agreement signed in the case of Buyer’s Agency. Susan and Jonathan will extend much effort, time, expertise, loyalty and education to be singularly informed on behalf of their buyers. If you should choose either of these to as your agent, they will not put you under pressure to buy. By the way the agreement can be cancelled at any time by notifying one another in writing.
